Software License Agreement


Please read this agreement carefully.




1. Definitions:


ATLJsoft – means ATLJsoft LLC, a company registered in Virginia.


Computer –- means an electronic device that manipulates data in digital form to obtain specific results based on a logical sequence of instructions.


Internal Network -- means a private, proprietary network of a business accessible only by employees of that specific business.  Local home networks which are accessible only by the Computer owner and immediate family members are also considered an Internal Network.  Internal Networks do not include the World Wide Web (Internet) or any other network open to the public.


Permitted Number -- means one (1) unless otherwise stated.


Software -- PSModel software and all its component parts, files, updates, and upgrades.


2. Conditions:


If you copy, install, or use all or any portion or components of the Software, you accept all the terms and conditions of this agreement.


You may have another written agreement directly with ATLJsoft -- e.g. a volume License -- that supplements all or portions of this agreement.


ATLJsoft owns all intellectual property in the Software.


The Software is Licensed, NOT SOLD.  ATLJsoft grants you the right to use the Software by the Permitted Number of individuals on the Permitted Number of primary Computers.    


For each primary Computer, a second copy of the Software can be installed on one additional Computer provided that the Software on the second Computer is not used at the same time that the Software on the primary Computer is used.


You may freely distribute output data from the Software in printed or electronic form.


3. File Server Deployments:


You may install up to the Permitted Number of copies of the Software on a file server within your Internal Network for the purpose of downloading and installing the Software on up to the Permitted Number of Computers within the same Internal Network.


4. File Server Use:


You may install up to the Permitted Number of copies of the Software on a file server within your Internal Network where the Software is executed by commands, data, or instructions from a Computer within the same Internal Network.  At any specific time, the number of individuals running or executing the Software cannot exceed the Permitted Number. 


5. Copyright:


The Software is protected by copyright laws and international treaties.  Your use of the Software is subject to the applicable copyright laws and the express rights and restrictions of this License Agreement.


6. Restrictions:


You may not rent, lease, or otherwise transfer the Software except as expressly authorized in this License Agreement.  You may not make the Software available over the World Wide Web or similar networking technology.  You may not remove any copyright, trademark, or other proprietary notices from the Software or Software output.  You may not reverse engineer, decompile, or disassemble the Software.


The Software may not be installed on an Internal Network file server that can be accessed by the public or by users that are not part of this License Agreement.




ATLJsoft warrants that the Software will substantially conform to the applicable Software product description or documentation accompanying the Software -- when installed on a Computer with the recommended operating system and hardware -- for a period of 90 days following receipt of the Software.




ATLJsoft shall not be liable for any loss, damages, claims, or costs whatsoever including:

1) consequential, indirect, or incidental damages;

2) any lost profits, or lost savings;

3) any damages resulting from business interruptions, personal injury or failure to meet any duty or care, or claims by a third party, even if an ATLJsoft representative has been advised of the possibility of such a loss, damages, claims, or costs.


ATLJsoft's aggregate liability shall be limited to the amount paid for the Software.  This limitation will apply even in the event of fundamental flaws in the Software.




The Software is intended as a tool for estimating the performance of a marine propeller.  These estimates can vary significantly from the performance of the propeller on an actual boat.  This variance can be due to many factors, including one or more of the following:

1) inaccurate or incorrect propeller geometry;

2) inaccurate or incorrect predictions of wake or water flow into the propeller;

3) lack of required torque, horsepower, or shaft Revolutions Per Minute (RPM);

4) inclination of the propeller shaft relative to water inflow velocity;

5) propeller blade and hub cavitation;

6) inaccurate measurement of boat speed;

7) inaccurate measurement of shaft or engine RPM;

8) inaccurate predictions of torque and\or horsepower losses in the propeller drive line;

9) inaccuracies in the original propeller series testing, test data, or published data;

10) possible bugs in the Software.


The user should validate the Software’s performance predictions by comparing these predictions to performances of similar propeller installations on actual boats.  Sources for doing this include the following:

1) propeller manufacturer representatives, literature, and websites;

2) boat manufacturer representatives, literature, and websites;

3) propeller related forums and bulletin boards on the World Wide Web;

4) local boat yards and propeller shops;

5) boat owners with similar propeller installations;

6) marine mechanics.


In addition, the HELP Section of the Software contains references for publications that offer the following:

1) technical discussions about propeller performance for various propeller types, applications, and installations;

2) propeller performance examples, calculations, and data.
